ONLINE PRIVACY POLICY AGREEMENT

FoodTrux, LLC, (FoodTrux) is committed to keeping any and all personal information collected of those individuals that visit our website and make use of our online facilities and services accurate and secure.

THEREFORE, this Privacy Policy Agreement shall apply to this website and the FoodTrux mobile applications (the “Services”) and any and all data collection and usage thereof. Through the use of the Services you are herein consenting to the following data procedures expressed within this agreement. Please read this policy carefully to understand our practices regarding your information and how we treat it.

This policy does not apply to information collected by:
• Us offline or through any other means, including on any other website or mobile application operated by any third party; or
• Any third party, including through any application or content (including advertising) that may link to or be accessible from or through the Website.

Children Under Age of 13

FoodTrux does not knowingly collect personal identifiable information from children under the age of thirteen (13) without verifiable parental consent. If it is determined that such information has been inadvertently collected on anyone under the age of thirteen (13), we shall immediately take the necessary steps to ensure that such information is deleted from our system’s database. Anyone under the age of thirteen (13) must seek and obtain parent or guardian permission to use this website.

Collection of Information

The Services collect various types of information, such as:
• Voluntarily provided information which may include your name, address, email address, phone number, billing and/or credit card information etc., which may be used when you purchase products and/or services and to deliver the services you have requested.
• Information automatically collected when visiting our Services, which may include cookies, web beacons, and other third party tracking technologies and server logs.
• Records and copies of your correspondence (including email addresses), if you contact us.

We collect certain information when users log in using their Google and Facebook social media logins. We use Google and Facebook logins only to uniquely identify each user. That means that when a user logs into the Services using a social media login, we fetch only minimum information necessary to uniquely identify each user while otherwise maintaining the user’s anonymity. We do not fetch any other information and we do not use the limited information we do fetch for any other purpose except as a way to uniquely identify each user.

As you navigate through and interact with our Services, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:
• Details of your visits to our Services, including pages you visit, the length of your visit, logs, location data, and other communication data and the resources that you access and use on the Services.
• Information about your computer and internet connection, including your IP address, operating system, browser type, network information and unique device identifiers. We may also collect and store your browser settings and preferences. We receive information about your interactions with our Services, such as the time spent interacting with our Services content and the dates and times of your visits to our Services.

We also may use these technologies to collect information about your online activities over time and across third-party websites or other online services (behavioral tracking). Currently, our web servers do not recognize or respond to “Do Not Track” signals and our Services may continue to collect information in the manner described in this policy. If you do not want us to collect this information, please do not visit the Services.

Although much of the information we collect automatically is only statistical data or other aggregated information, it may include personal information, or we may maintain it or associate it with personal information we collect in other ways or receive from third parties. This information helps us to improve our Services and to deliver a better and more personalized service, including by enabling us to:

Unsubscribe or Opt-Out

All users and/or visitors to our Services have the option to discontinue receiving communication from us and/or reserve the right to discontinue receiving communications by way of email or newsletters. To discontinue or unsubscribe to our Services please send an email that you wish to unsubscribe to info@FoodTrux.co. If you wish to unsubscribe or opt-out from any third-party website, you must go to that specific website to unsubscribe and/or opt-out.

FoodTrux does not claim nor accept responsibility for any privacy policies, practices and/or procedures of other such websites. Therefore, we encourage all users and visitors to be aware when they leave our Services and to read the privacy statements of each and every website that collects personally identifiable information. This policy applies only and solely to the information collected by our Services.

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure.

Through the use of our Services, you are hereby accepting the terms and conditions stipulated within this Privacy Policy Agreement. If you are not in agreement with our terms and conditions, then you should refrain from further use of our Services. Subject to certain exceptions, you have the right to request that FoodTrux limit the use of your sensitive personal information. FoodTrux does not currently collect sensitive personal information.

Right to Non-Discrimination

You have the right to not be discriminated against by us because you exercised any of your rights under the CPRA or other laws. This means we cannot, based solely upon your elections regarding personal information:

  • Deny goods or services to you;
  • Charge different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties;
  • Provide a different level or quality of goods or services to you; or

Suggest that you will receive a different price or rate for goods or services or a different level or quality of goods or services.

Response Timing

When you make a request exercising your CPRA or other state rights, FoodTrux will confirm receipt of your request within 10 business days and respond to a verifiable request within 45 days.

To appeal a decision regarding a consumer rights request, please send us a follow-up email to info@foodtrux.co, noting that the email is an appeal of the decision made by FoodTrux with respect to your initial consumer rights request.  This follow-up email will initiate the appeals process, and FoodTrux will inform you of any action taken or not taken in response to your appeal within any timeframe prescribed by the applicable statute.

CPRA – NOTICE AT COLLECTION

Under the California Consumer Privacy Rights Act (“CPRA”), California consumers are entitled to a notice at or before the point of collection of their personal information.  This notice serves as FoodTrux Notice at Collection as required by the CPRA.

FoodTrux may collect personal information from you and use it for the specified purposes listed in our privacy policy.

FoodTrux is collecting your personal information to support its business operations, including for the business purposes listed in the FoodTrux Privacy Policy. We do not collect sensitive personal information.

We will not sell the personal information we collect or share it with third parties for cross-context behavioral advertising.
